US Constitutional Law
What is constitutional law? This is indeed a very big question. Just the scope of this term is so large that an article can’t encompass its dimension. Essentially the Constitutional law encompasses all the foundation laws that the country may be based upon. In US the constitutional law regulates how the government should create and execute various laws for public welfare. It also puts down the scope of power and authority enjoyed by government. In short, it is the final word in any matter. It goes to outline the power of the government, state as well as the people. So what is constitutional law in US? Why does it exist?
In the United States, constitutional law is the body that governs the US constitution. It tells us how to implement and interpret the US constitution. It gives us the various terms of the Constitution and also tells us the range and use of these terms. The constitutional law deals with many important issues like relationships between states and federal governments, rights of individuals and citizens of US etc.
United States has the oldest living written national constitution. This constitution was adopted on September 17th, 1787 at the constitutional convention at Philadelphia, Pennsylvania. In the United States, the constitution is regarded as the most supreme law. It consists of a preamble, seven articles, twenty-seven amendments and a paragraph that shows its enactment by the constitutional convention.
Many argue that the US constitution consists a vast list of rules and even the language used is archaic. As such they find that it is arbitrary and so open to interpretations. In short they mean that the constitution should be not adopted literally. The constitution of US is thus a field of law that is broad as well as complex. Many others argue that constitutional scholars have purposefully kept the constitutional terms vague so as to adapt itself to the changing needs of the society. Even today many a times, judges still remain divided by how to interpret certain portions of the constitution. Finally, the argument goes on as to whether the constitution should be interpreted as a guideline, keeping the best interests of public at large or whether they should be interpreted specifically.
Constitutional law includes all other forms of law. It is so huge that it is difficult to encompass it at one go. Many law books have been detailing it to us for better reference. This law supercedes all other laws. It also points out the foundation of the United States of America. In fact the formation of US and adoption of a uniform US constitution is what adds so much glory to its wonderful past.
According to Article 7, ratification by at least nine special state conventions was required to bring this into force in the United States. The people who supported this adoption of constitution came to be known as federalists while those who opposed were called the anti-federalists. Inspite of their contrasting view points regarding formation and nature of federal government, the federalists eventually won the debate and all the 13 states ratified the constitution, giving them a clean and great victory!
